Harassment & Bullying Policy

Our Commitment

ProCons is committed to providing a safe, respectful, and inclusive workplace for all employees, contractors, clients, and visitors. We do not tolerate harassment, bullying, or any form of inappropriate behaviour in the workplace.

This policy supports our obligations under the Occupational Health and Safety Act 2004 (Vic) and reflects our commitment to promoting a positive workplace culture where everyone is treated with dignity and respect.


Scope

This policy applies to:

  • All ProCons employees
  • Contractors and subcontractors
  • Labour hire personnel
  • Visitors and clients

It applies across all workplaces, including offices, construction sites, client locations, training environments, work‑related travel, and work‑related social activities.


What Is Workplace Bullying?

Workplace bullying is repeated, unreasonable behaviour directed toward a worker or group of workers that creates a risk to health and safety.

Examples of bullying may include (but are not limited to):

  • Verbal abuse, shouting, or offensive language
  • Intimidation, threats, or aggressive behaviour
  • Repeated unreasonable criticism or humiliation
  • Deliberate exclusion or isolation
  • Withholding information required to perform work safely
  • Unreasonable work demands or deadlines
  • Deliberately changing rosters or duties to disadvantage a worker

Reasonable management action, carried out in a lawful and respectful manner (such as performance management or disciplinary processes), does not constitute bullying.


What Is Harassment?

Harassment is any unwelcome behaviour that a reasonable person would expect to offend, humiliate, or intimidate another person.

This may include:

  • Offensive jokes, comments, or gestures
  • Disrespectful or discriminatory language
  • Inappropriate physical behaviour
  • Displaying offensive materials

Harassment can occur between workers, contractors, supervisors, clients, or visitors.


Responsibilities

ProCons Management Will:

  • Provide a safe workplace free from bullying and harassment
  • Take all reports seriously and act promptly
  • Ensure matters are handled confidentially and fairly
  • Comply with all legislative reporting obligations
  • Support affected workers throughout the process

Workers and Contractors Must:

  • Treat others with respect at all times
  • Not engage in bullying or harassment
  • Report incidents or hazards as soon as practicable
  • Cooperate with investigations when required

Reporting Bullying or Harassment

If you experience or witness bullying or harassment, you are encouraged to report it as early as possible.

Reports can be made to:

  • Your Supervisor or Manager
  • A ProCons Director
  • Human Resources (where applicable)

All reports will be handled confidentially, sensitively, and without bias.


Investigation Process

ProCons will:

  1. Assess the complaint promptly
  2. Take appropriate interim actions if required
  3. Conduct a fair and impartial investigation
  4. Communicate outcomes where appropriate
  5. Implement corrective actions if necessary

Disciplinary action may be taken where a breach of this policy is substantiated.


No Victimisation

ProCons will not tolerate victimisation or retaliation against any person who raises a concern or participates in an investigation in good faith. Any such behaviour will be treated as a serious breach of this policy.


Support

Workers affected by bullying or harassment will be offered appropriate support during and after the investigation process.


Policy Review

This policy is reviewed regularly and updated as required to ensure ongoing compliance with legislation and best practice workplace standards.
